Who We Are
Meso Healthcare is a healthcare practice led by Wayne C. Presutti, APRN - FPA, located at 8556 S Ashland Ave, Chicago, IL 60620. We provide primary care, mental health, infectious disease, and related healthcare services. We are required by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the Illinois Medical Patient Rights Act (410 ILCS 50) to maintain the privacy of your protected health information (PHI) and to provide you with this Notice of our legal duties and privacy practices.
How We May Use and Disclose Your Health Information
For Treatment: We may use and share your health information with doctors, nurses, technicians, and other healthcare professionals involved in your care. This includes coordinating your treatment, consulting with other providers, and referring you for additional services.
For Payment: We may use and share your health information to bill and collect payment for services. This may include sharing information with your insurance company, Medicare, Medicaid, or other third-party payers to obtain prior authorization or to determine eligibility for benefits.
For Healthcare Operations: We may use your health information to support the day-to-day activities and management of our practice, including quality improvement, staff training, compliance auditing, and business management.
Other Permitted Uses and Disclosures
We may also use or disclose your health information without your written authorization in certain situations permitted or required by law, including: as required by federal, state, or local law; for public health activities; to report suspected abuse, neglect, or domestic violence; for health oversight activities; in response to a court order or subpoena; for law enforcement purposes; to avert a serious threat to health or safety; for workers' compensation; for organ donation purposes; for research under specific conditions; for certain government functions; and to comply with the Illinois Department of Public Health reporting requirements.
Uses and Disclosures Requiring Your Written Authorization
We will obtain your written authorization before using or disclosing your PHI for purposes not described in this Notice, including: most uses of psychotherapy notes, marketing purposes, and the sale of your health information. You have the right to revoke your authorization in writing at any time, except to the extent we have already relied on it.
Special Protections Under Illinois Law
Illinois law provides additional protections for certain categories of health information. Under the Illinois Mental Health and Developmental Disabilities Confidentiality Act (740 ILCS 110), records of mental health services receive heightened protections and generally require your specific written consent before disclosure, except in limited circumstances. Under the AIDS Confidentiality Act (410 ILCS 305), HIV test results and related information are subject to strict confidentiality requirements. We comply with these Illinois-specific protections in addition to federal HIPAA requirements.
Your Rights Regarding Your Health Information
Right to Inspect and Copy: You have the right to inspect and obtain a copy of your health information maintained by our practice. We may charge a reasonable fee as permitted by Illinois law.
Right to Request Amendment: You may request that we amend your health information if you believe it is incorrect or incomplete. We may deny this request under certain circumstances and will provide you with a written explanation.
Right to an Accounting of Disclosures: You have the right to receive a list of certain disclosures we have made of your health information in the six years prior to your request.
Right to Request Restrictions: You may request restrictions on how we use or disclose your health information for treatment, payment, or healthcare operations. We are not required to agree to your request unless the disclosure is to a health plan for payment or healthcare operations and the information pertains to services you paid for in full out of pocket.
Right to Request Confidential Communications: You may request that we communicate with you in a specific way or at a specific location. We will accommodate reasonable requests.
Right to a Paper Copy: You have the right to obtain a paper copy of this Notice at any time, even if you have agreed to receive it electronically.
Right to Be Notified of a Breach: You have the right to be notified if a breach of your unsecured PHI occurs, in accordance with HIPAA and Illinois law (815 ILCS 530, Personal Information Protection Act).
Our Duties
We are required by law to maintain the privacy and security of your PHI, to provide you with this Notice of our legal duties and privacy practices, and to follow the terms of the Notice currently in effect. We reserve the right to change the terms of this Notice and to make new provisions effective for all PHI we maintain. If we make a material change, we will post the revised Notice on our website and make copies available at our office.
Filing a Complaint
If you believe your privacy rights have been violated, you may file a complaint with our practice or with the U.S. Department of Health and Human Services Office for Civil Rights. You will not be penalized or retaliated against for filing a complaint.
